Meezy Picks Code of Conduct Statement

In today’s online market, we believe that honesty is the best policy. That’s why we designed the most generous, fair and transparent server policy for our customers. Read the following sections to find out more about how we operate. Please don’t hesitate to contact us if you have any questions.

i) Server Policy

There is zero tolerance for toxicity, disrespect, or hating of any kind towards others, moderators, or cappers. We do not promote negativity of any kind. This community was created to be a positive environment for everyone to better themselves and will remain as such. If you are caught violating these policies you will be kicked out and not refunded for your purchase.

ii) Server Rules

No hate speech or toxicity

No posting of anything NSFW

No posting of external discord servers.

No spam of any kind.

No promoting other services that have not been approved by Meezy Picks.

Please keep the discussion of each room relevant to what the room is designed for.

Please do not post inappropriate images, GIFS, memes in chats. If you do, your post will be deleted and repeat offenders will be kicked and banned.

Again, any repeat violators of these rules may be subjected to kick/ban or termination of account with a strict no refund policy.

iii) Refund Policy

Refund requests must be initiated within 48 hours of purchase of subscription or passes, and we may offer limited refunds on purchases depending on a review of circumstances. When reviewing refund requests, we primarily look at historical refund requests from purchasers’ accounts and actions taken with respect to those requests. Decisions whether to refund a subscription purchase are solely within Meezy Picks discretion.

Outside of the example above, we do not offer refunds for recurring subscriptions except in circumstances where technical issues impact the purchase or benefits relating to a subscription, or where the purchase of a subscription was fraudulently made.

iv) Subscription Cancellation

You may cancel your subscription up to 24 hours before your Sub Renew Date (which can be viewed on your Subscriptions page). To do so, select the “Do Not Renew” option under your Subscription settings at meezypicks.com/account

v) Termination Policy

To the fullest extent permitted by applicable law, Meezy Picks reserves the right, without notice and in our sole discretion, to terminate your license to use Meezy Picks Services (including ability to access and post in the discord), and to block or prevent your future access to and use of the Meezy Picks Services, including where we reasonably consider that: (a) your use of the Meezy Picks Services violates these Terms of Service or applicable law; (b) you fraudulently use or misuse the Meezy PicksServices; or (c) we are unable to continue providing the Meezy Picks Services to you due to technical or legitimate business reasons. Our right to terminate your license includes the ability to terminate or to suspend your access to any purchased products or services, including any subscriptions, day, or week passes. To the fullest extent permitted by applicable law, your only remedy with respect to any dissatisfaction with: (i) the Meezy Picks Services, (ii) any term of these Terms of Service, (iii) any policy or practice of Meezy Picks in operating the Meezy PIcks Services, or (iv) any content or information transmitted through the Meezy Picks Services, is to terminate your account and to discontinue use of any and all parts of the Meezy Picks Services.

vi) Liability statement

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT SHALL MEEZY PICKS OR MEEZY PICKS PARTIES BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE MEEZY PICKS SERVICES, THE CONTENT OR THE MATERIALS, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE ON ANY INFORMATION OBTAINED FROM MEEZY PICKS, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO MEEZY PICKS RECORDS, PROGRAMS, OR SERVICES

vii) Indemnification Statement

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Meezy Picks, its affiliated companies, and each of our respective contractors, employees, officers, directors, agents,  third-party suppliers, licensors, and partners from any claims, losses, damages, demands, expenses, costs, and liabilities, including legal fees and expenses, arising out of or related to your access, use, or misuse of the Meezy Picks Services, any User Content you post, store, or otherwise transmit in or through the discord or other Meezy Picks Services, your violation of the rights of any third party, any violation by you of these Terms of Service, or any breach of the representations, warranties, and covenants made by you herein. You agree to promptly notify the Meezy Picks Parties of any third-party claim, and Meezy Picks reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Meezy Picks, and you agree to cooperate with Meezy Picks defense of these claims. Meezy Picks will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
